When questioning the legality of CBD in Belgium, it's important to differentiate between the condition of cannabis and that of cannabidiol. While cannabis is considered a narcotic substance, it is not authorized in Belgium. This is also the case for medical cannabis as stipulated in the Royal Decree of June 11, 2015, which regulates products based on one or more tetrahydrocannabinols).

Similarly, the cultivation of cannabis for medical or even scientific purposes is prohibited in Belgium . However, there is an exception for this point. Some growers can obtain a derogation from the local authorities (in Flanders the ministerial decree of January 23, 2015 executing the Flemish Government decree of October 24, 2014 and in Wallonia, the European regulations (EU1307/2013, EU 1306/2013, R809/2014 and EU 639/2014) are valid). Conversely, cannabidiol (CBD) and preparations based on this molecule are not banned in the country. In fact, pharmacies are able to sell CBD-based medicines and various preparations without a prescription. In fact, for a CBD-based product to be considered legal in Belgium, it must contain less than 0.2% THC.

Cannabis is considered a drug in Belgium. The plant falls into the category of narcotics, and its possession or consumption is prohibited by local legislation. However, possession of cannabis for personal use (under 3g) is simply punishable by a fine.

Medical cannabis is not authorized in Belgium either. Even pharmacies are not fit to dispense medicinal cannabis, according to the Royal Decree of June 11, 2015 regulating products containing one or more tetrahydrocannabinols.

Exception made for two cannabis-based medicines authorized by the European Union. Pharmacists are authorized to dispense Sativex® and Epidyolex® (not yet marketed in France) on prescription. They can also supply CBD-based magistral preparations if they meet the criteria set out in Circular 648.

Other cannabinoids, such as CBC, CBN, CBG, etc., are not illegal in Belgium. are not illegal in Belgium if the form in which they are marketed contains no more than 0.2% THC.
